New petition against accumulative pensions filed to Constitutional Court
A petition for suspension of several other articles of the Law on Accumulative Pensions has been filed to the Constitutional Court of Armenia (CC), the deputy of ARF-Dashnaktsutyun parliamentary faction Artsvik Minasian wrote on his Facebook page.
The petition says that on January 24 the CC suspended Article 76 and Article 86 part 4 of the Law on Accumulative Pensions. In the new petition, the deputy asked to suspend Articles 8, 8.1, 14, 37 and 38 until the court finishes examining the Law on Accumulative Pensions.
Although Article 76 concerning responsibility has been suspended and employers were exempted from responsibility for non-payment of compulsory accumulative contributions to pension funds, nevertheless a number of state organizations and other employers make deductions from the salaries of employees – on the instruction of the State Revenue Committee – and in some cases they also make employees choose pension funds and managers.
Numerous citizens and employers oppose this practice and expect explanations for protection of their rights and legal interests.
“Taking into account the need to ensure objectivity of the legal proceedings due in 2014 and to avoid possible irrecoverable financial losses, I ask you to suspend Articles 8, 8.1, 14, 37 and 38 of the Law on Accumulative Pensions”, the petition reads.
In the event that the Constitutional Court takes a decision to grant the request of the applicants, those participants who will choose a pension fund and a manager and pay money prior to the court decision will have the right to get that money back and receive compensation for the loss by the state or other subject.
