Investigative Committee cannot be set up if criminal cases are filed over same case – MP
According to the NA Regulation law a committee cannot be set up if a criminal case has been filed into the same case, Yelk faction MP Edmon Marukyan said at the NA extraordinary sitting today.
The sitting has been convened to set up investigation committee over wiretapping of conversation between the NSS director and SIS chief.
Marukyan reminded that two criminal cases have been filed into the case under different articles, thus, NA committee cannot be set up.
Chairman of the State Legal Affairs Committee Gevorg Kostanyan said they considered the matter that is why they propose global view to the issue.
“Criminal cases have been filed over concrete facts but we want to discuss not the concrete case but the issue globally,” Kostanyan said.
Marukyan though reminded that the draft decision on setting up the committee mentions the fact of wiretapping of heads of force institutions thus the committee is being set up over this wiretapping case which is not allowed by the NA Regulation law.
“If the text wording is the issue we may change it,” Kostanyan said, adding that these case created a ground for the discussion of issue of privacy of phone conversations in general.
