Armenian Prosecutor General states necessity of Kocharyan’s arrest in this phase of case investigation
The position of the Armenian Prosecutor General’s office is that Armenia’s second president Robert Kocharyan should be under arrest in this phase of examination of March 1 criminal case, Prosecutor General Artur Davtyan told the reporters today.
“Our position is that Robert Kocharyan must stay under arrest. We present our grounding which testifies that there is such a necessity in this phase of examination of the case,” Davtyan said, adding that no one knows what decision the court will make.
The Prosecutor General stressed that facts gathered over the case significantly differ from the ones gathered in 2008. In short, the revealed facts speak about absolutely other reality.
As to the possibility of applying to Constitutional Court regarding Kocharyan’s immunity, Davtyan said there are no legal directions for doing it as the Court of Cassation has clearly given answer to it.
“The Court of Cassation has not stated that the issue must be assessed by the Constitutional Court, it clearly stated that the Court of Appeal must analyze the basic suspicion, assess whether it stems from the status or not. If it is not, there is no issue of immunity, and there is no need of CC to state anything,” the Prosecutor General said.
