If disputed articles recognized unconstitutional Kocharyan’s case to be closed: Attorney
Armenia’s second president Robert Kocharyan’s defense team continues submitting petitions during the examination of Prosecutor General’s petition to change preventive measure against him.
During the break, team member Aram Orbelyan said during the session they managed to present only one of the petitions which related to the permissibility of evidence allowing arrest.
Earlier the defense team stated that the evidence submitted to the court is not permissible.
Orbelyan said they are making an inquiry on whether the court may make an arrest decision based on materials not considered as evidence.
Earlier Hayk Alumyan stated that they consider the 2008 0038 order of defense minister impermissible evidence in the case.
The other petition to be submitted to the court relates to the Article 300 of the 2008 Criminal Code and some other articles. Orbelyan said the article does not correspond to legal certainty. He stressed that if the court decides to apply to the Constitutional Court it will apply, if not, it will not.
He said if the articles are recognized anti-constitutional it will serve as a basis for closing the case without any accusations.
The attorney also said that the prosecutors are against the petitions submitted by the defense team.
