CC partially upholds Robert Kocharyan’s application recognizing one article constitutional, one not
The Article 35 of Criminal Procedure Code is unconstitutional and invalid but the second part of the Article 135 of the same legislation is constitutional, the chairman of the Constitutional Court Hrayr Tovmasyan read the ruling made by the CC based on the application of Armenia’s second president Robert Kocharyan.
The second president applied to the Constitutional Court for considering the constitutionality of the two articles of the Criminal Procedure Code, and with respect to the grounds for applying preventive measure, and the circumstances that rule out the proceedings of the criminal case or the criminal prosecution against him.
According to the decision, the second president’s personal freedom has been violated.
