Constitutional Court denies examination of second president’s application
Constitutional Court has rejected the examination of application of the second president Robert Kocharyan.
The CC said in the statement that the decision was made at the October 18 working session.
Speaking to Aysor.am Kocharyan’s attorney Aram Vardevanyan said the application refers to the issue of giving mandatory proceeding to the appeal by the Court of Cassation in case of being arrested by the decision of the Court of Appeal.
“We find that when the Court of Appeal applies arrest, the Court of Cassation is obliged to take into proceeding the appeal, as the person must always have an opportunity to appeal the decision of arrest,” Vardevanyan said.
He stressed that there is no legal impediment for the Court of Cassation to accept such applications.
Vardevanyan said they will get familiarized with the CC’s decision and then announce their position.
