Bright Armenia faction head says administrative fines, reports formed this period should be recalled
The commandant had no right to adopt normative legal act but he did, head of Bright Armenia faction Edmon Marukyan said at the discussion of bill on making changes in the law on State of Emergency Regime and on Normative Legal Acts.
“You are legalizing what the commandant has decided. The commandant had no right to adopt normative legal acts but he did and now you are legalizing it, saying that it acts with transition provisions with retrospective force,” Marukyan said, addressing to the deputy justice minister Rafik Grigoryan.
He stressed that the commandant had no right to apply restrictions and urged to annul the administrative reports formed during this period.
“Administrative reports have been formed on over 10,000 citizens for violating the restrictions. Don’t you think this reports must be recalled, be recognized invalid as, in essence, they did not have legal grounds while now you are creating them,” Marukyan said.
The deputy minister said that all the acts were lawful.
“The Constitution, international experience envisage the opportunity to adopt acts, we just make clarifications,” he said, adding that the movement restrictions are envisaged by the decision adopted by the government while the administrative reports and fines were applied in accordance with the law on administrative violations adopted by the parliament.
In response, Marukyan stressed that the restriction rules have been set by the commandant.
"The commandant is the one who set in what cases the fines must be applied while he has no authority to adopt normative legal acts. If he had such right why have you brought this bill to the parliament? You know quite well that he didn’t,” Marukyan stressed.
