Armenia’s CC urges officials not to go beyond scope of powers defined by the Constitution and laws: statement
Armenia’s Constitutional Court released a statement in response to the statement of the Minister of Justice Rustam Badasyan.
“In response to the statement by the Minister of Justice on termination of the powers of the president of the Constitutional Court and the dismissal of three other judges in two days, we, the undersigned, inform that:
According to Article 167 of the Constitution, the powers of the Constitutional Court are being defined by the Constitution and the procedure of its formation and activities by the Constitution and Law on Constitutional Court.
The Part 5 of the Article 88 of constitutional law on Constitutional Court defines that before the 2015 amendments entered into force the CC president and members continue their tenure after 12 years until the end of the term of their authorities set by the 2005 Constitutional amendments.
The above mentioned norm of the constitutional law on CC has not been disputed in the CC, has not been recognized as contradicting theConstitution and has not been recognized invalid by the NA. Thus, it is a functioning norm and is subjected to implementation. Based on the above mentioned, we urge the relevant officials not to go beyond the scope of the powers defined by the Constitution and the laws,” the statement said.
