ECHR will not apply interim measure in case of CC ex-judges
The European Court of Human Rights has decided not to apply interim measure in the case of former three judges of Armenia’s Constitutional Court against Armenia.
The judges Alvina Gyulumyan, Hrant Nazaryan and Felix Tokhyan as well as CC chairman Hrayr Tovmasyan demanded that ECHR suspend the constitutional amendments adopted by the parliament in the period of consideration of the application about violation of their rights.
In case of interim measure they would have continues working until the discussion of the main application.
The European Court decided to reject the request as out of scope. According to the Court’s wellestablished practice, requests fall outside the scope of application of Rule 39 of the Rules of Court when they do not involve a risk of serious and irreparable harm of a core right under the Convention.
The ECHR though will consider the main application of the judges.
