Armenian side to appeal European Court Chamber’s ruling on Gurgen Margaryan’s case to Grand Chamber
On May 26, 2020 European Court of Human Rights made a ruling on Mukuchyan and Minasyan vs Azerbaijan and Hungary case relating to the legality of extradition of Ramil Safarov from Hungary to Azerbaijan, his pardoning and glorification, representatives of applicants in the ECHR Siranush Sahakyan and Levon Gevorgyan report.
The European Court found that by pardoning the brutal criminal, Azerbaijan violated the right of living of Gurgen Margaryan and Hayk Mukuchyan guaranteed by the Article 2 of the European Convention on Human Rights and registered Azerbaijan’s institutionalized policy of ethnic discrimination against Armenians.
Nevertheless, the ECHR did not attribute the assassination of Gurgen Margaryan and assassination attempt of Hayk Mukuchyan to Azerbaijan basing on the conclusion of the Hungarian court's ruling that Safarov committed the crime in private status. The European court also freed Hungary from responsibility.
Armenian side will appeal the European Court Chamber’s ruling on Gurgen Margaryan’s case at the Big Chamber until it enters into force.
