Ex-top military Onik Gasparyan’s lawyers to apply to European Court unless violations are not eliminated by Armenia’s instances
Lawyers of former chief of General Staff of the Armenian Armed Forces Onik Gasparyan are ready to reach to the European Court of Human Rights (ECHR).
“If the violation is not eliminated in Armenia, yes, we will apply, I am always optimistic and see the possibility of elimination of human rights violations in the sidelines of the Armenian court instances. The small part that does not eliminate here must be eliminated in the European Court,” lawyer Aram Orbelyan told the reporters.
He said there is no need to view the ECHR as the only instance implementing historic justice.
“My expectation is that rights of Mr Gasparyan be defended by the Armenian judicial and law enforcement bodies,” the lawyer said.
The lawyer added that the prime minister who finds that the court’s decision may be left without implementation and ask the court change the decision must be subjected to political responsibility.
“Such approach in all developed countries I know would have evidently resulted in political consequences, following the criminal consequences too, as not implementation of court’s ruling is considered a crime,” Orbelyan said.
